In the annex to my Application to the Government of the Russian Federation (the Application is dated and sent by e-mail on April 27, 2022), I have listed the documents - results of my appeals to the Ministry of Finance of the Russian Federation:
(11) application, dated February 16, 2022, to the Ministry of Finance of the Russian Federation and
(12) application, dated March 17, 2022, to the Ministry of Finance,
(13) response dated 08 April 2022 No. 15-1329/22 of the Department of State Registration of Rights of the Office of the Federal Service for State Registration, Cadastre and Cartography for the Rostov Oblast,
(14) application, dated April 11, 2022, to the Ministry of Finance of the Russian Federation,
(15) response No. 03-05-06-01/36321 dated April 22, 2022 (sent to me by the Ministry of Finance of the Russian Federation).
Thus, before my appeal to the Government of the Russian Federation, I received at least two documents in connection with my appeals to the Ministry of Finance of the Russian Federation:
response dated 08 April 2022 No. 15-1329/22 of the Department of State Registration of Rights of the Office of the Federal Service for State Registration, Cadastre and Cartography for the Rostov Oblast,
response No. 03-05-06-01/36321 dated April 22, 2022 (sent to me by the Ministry of Finance of the Russian Federation).
Why was I sent a reply dated April 08, 2022 No. 15-1329/22?
The fact is that the Ministry of Finance of the Russian Federation, having received my application, dated February 16, 2022, redirected it to the Federal Registration Service of the Russian Federation ('The Office of the EGRN Rosreestr (hereinafter referred to as the EGRN) from the Ministry of Finance of the Russian Federation received an appeal by Zelessky [spelling saved] dated February 16, 2022 ( hereinafter referred to as the Appeal)." - Letter No. 01-00734/22@ dated March 15, 2022 from the Rosreestr of the Russian Federation).
Having received my application dated February 16, 2022, the Rosreestr system conducted an audit and informed me (reply dated April 08, 2022 No. 15-1329/22) and the Ministry of Finance of the Russian Federation about the results of the audit.
The Ministry of Finance of the Russian Federation, having received the results of the check from Rosreestr, sent me a response (response dated No. 03-05-06-01/36321 dated April 22, 2022).
I appealed this answer to a higher authority - to the Government of the Russian Federation (April 27, 2022).
The check conducted by Rosreestr (response dated No. 03-05-06-01/36321 dated April 22, 2022) had the positive effect that it confirmed:
(1) my ownership rights (for considered object of real estate) before of June 3, 2019,
(2) showed the the area of the object of real estate previously registered in my name (144.9 square meters plus a balcony, part of terrace a 32.5 square meter ),
(3) the indisputability of my rights - the prompt (from the official level) to me to engage in a 'new' registration of 'new rights' testifies to the obviousness and indisputability of my rights.
Having sent an application to the Government of the Russian Federation on April 27, 2022, I have been waiting and is waiting for a response.
The answer from the Government of the Russian Federation has not yet been received, but documents continue to be received from the Rosreestr system.
In general, the receiving documents correspond to the logic of the answer dated April 08, 2022 number 15-1329/22.
In one form or another, the question is put about my capability to re-register my rights of ownership regarding object of real estate.
3 years have passed since the formal loss of my ownership of the property (2019 - 2022).
There are many circumstances associated with this object of real estate that I cannot prove, so I will not go into details.
One way or another, at least two judicial acts are associated with this object of real estate. Where is the guarantee that a new judicial act will not appear? I would like to get out (at last) from this "space" ...
Litigation around this object of real estate is not very conducive to its popularity among buyers and to the growth of its price.
What is the current state of this object? I did not appear in it for a long time. As far as I understand, it has been de-energized for a year or more - so I assume, based on the information received when paying for electricity (I continue to try to submit the meter readings).
To find (to gain):
(a) the ability to re-register my right of ownership?
(b) the opportunity to see the object that is unknown in what state?
(c) the ability to start selling the object of real estate that has at least two judicial acts associated with it?
My strength and health are clearly not enough for such acquisitions.
Since such a situation has developed, I will proceed from its logic.
Therefore, I do not follow the path of a new registration of property rights (regarding object of real estate), but I ask to pay me compensation. I agree with the conversion of a real estate object and a land plot to federal (regional, city) ownership - with subsequent use in the public interest.
Letters continue to come from the Rosreestr system.
Today, June 24, 2022, I found an email dated June 23, 2022 number 08-0925/22. Signed by the Head of the Department for Coordination and Analysis of Activities in the Accounting and Registration Sphere of the Office of the Federal Service for State Registration, Cadastre and Cartography for the Rostov Oblast [unofficial translation].
I will quote some of the provisions of this letter:
'In pursuance of the order of the Federal Service for Registration, Cadastre and Cartography dated May 30, 2022 No. 01-01496 / 22 (hereinafter referred to as the Order), the Department for Coordination and Analysis of Activities in the Accounting and Registration Sphere of the Office of the Federal Service for State Registration, Cadastre and Cartography for the Rostov Oblast ...informs on the following.

You and the owner of the premises with a cadastral number have the right to simultaneously apply to the rights registration authority by submitting: a copy of the Decision; a copy of a judicial act eliminating discrepancies in the patronymic of the right holder of the original property and the person specified in the operative part of the Decision; a technical plan, drawn up in the form of one document with the number of details of its section "Characteristics of the building", containing information about the formed buildings corresponding to the number of formed buildings (blocks of a block of flats); having paid the state fee for state registration of rights in accordance with subparagraph 22 of paragraph 1 of Article 333.33 of the Tax Code of the Russian Federation." Yes, indeed, I have such a right, and I have been repeatedly informed about this before.
However, this is a right, not a duty. Therefore, I have the right to choose legal options to protect my interests.
I chose the payment of compensation - as a way to protect my interests in the current (without of my participation) situation.
It was about the payment of compensation that I asked the Ministry of Finance of the Russian Federation, about the payment of compensation I ask the Government of the Russian Federation.
At the same time, it seems strange to me that a real estate object is withdrawn from the 'tax base', 'released' from the owner ...
But what about security? Ensuring public safety?
Where is the state protection of the constitutional right to property?
But what about, for example, the possibility of inheritance?
